Possession of a Firearm by a Convicted Felon

When you are a convicted felon or a juvenile delinquent, there are many rights you lose. One of those rights is the right to possess a firearm. The State must prove that:

  1. You are a convicted felon or an adjudicated juvenile delinquent AND
  2. You possessed a firearm. The possession can be actual or constructive. Actual possession of a firearm means it is on your person, either in your hand, in a coat pocket, pants pocket or a holster. Constructive possession means you don’t have to be touching the firearm to possess it. To be constructive possession it must be proven that you have control and dominion over the gun. You and you alone.
